Terms of Service

These Terms of Service ("Terms") govern your access to and use of qubixquantum.com and the Qubix services (the "Service"), operated by Qubix Quantum ("Qubix", "we", "us"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and legally able to enter into a contract. You are responsible for ensuring that using the Service is lawful in your country. The Service may not be available in all jurisdictions.

2. What Qubix is

Qubix provides access to real quantum computing hardware through an AI layer that turns plain-language requests into quantum circuits, runs them on third-party quantum hardware (e.g. IBM Quantum), and returns the results. The Service relies on third-party infrastructure (quantum providers, the Solana blockchain, hosting and payment providers) that we do not control.

We may change, suspend, or discontinue any part of the Service at any time without liability.

3. Accounts

(Applies to the Qubix app.) If you create an account or connect a wallet, you are responsible for keeping your credentials and your wallet's private keys secure. We will never ask for your private keys or seed phrase. Any activity under your account is your responsibility.

4. Acceptable use

You agree not to:

use the Service for any unlawful purpose, fraud, or money laundering;
attempt to disrupt, attack, reverse-engineer, or gain unauthorised access to the Service or its infrastructure;
use the Service to generate or run anything harmful, or to violate the terms of the underlying quantum, blockchain, or payment providers;
misrepresent your identity or infringe anyone's rights.

We may suspend or terminate access for any breach.

5. Intellectual property

The Website, Qubix branding, and software are owned by us or our licensors. You may not copy, modify, or redistribute them without permission. Results you generate through the Service are yours to use, subject to these Terms and the terms of the underlying providers.

6. The QBX token — important disclaimers

Read this section carefully.

Utility, not an investment. QBX is a utility token intended to provide access to and functionality within the Qubix platform. It is not a share, security, financial instrument, e-money, or deposit, and it does not represent any ownership, equity, debt, or right to profits in Qubix or any entity.
No expectation of profit. We make no promise or guarantee about the value, price, liquidity, or future performance of QBX. The token may lose all of its value.
High risk. Crypto-assets are volatile and experimental. You may lose everything. Only interact with crypto-assets if you understand and accept these risks.
Not financial advice. Nothing on the Website or in the Service is financial, investment, legal, or tax advice. Do your own research and consult qualified professionals before making decisions.
No public sale. (Adjust if this changes.) QBX is not offered for sale to the public by us as an investment opportunity. Any distribution is for utility and access purposes. If we ever conduct a public offer, additional terms and disclosures will apply.
Regulatory status. The regulatory treatment of crypto-assets is evolving (including under the EU Markets in Crypto-Assets Regulation, "MiCA"). Availability may be restricted in certain jurisdictions. It is your responsibility to comply with the laws that apply to you, including tax obligations on any crypto-asset you hold or use.
Your responsibility. Blockchain transactions are irreversible. You are solely responsible for your wallet, transactions, and the security of your keys. We cannot reverse, refund, or recover transactions made on-chain.

7. Third-party services

The Service depends on third parties (IBM Quantum, the Solana network, Helio, Supabase, Netlify, Cloudflare, and others). We are not responsible for their availability, performance, security, fees, or actions. Your use of them may be subject to their own terms.

8. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy of quantum results, uninterrupted availability, or error-free operation. Quantum computation is probabilistic and experimental; we do not warrant any particular result.

9. Limitation of liability

To the maximum extent permitted by law, Qubix Quantum and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, tokens, or funds, arising from your use of the Service. Where liability cannot be excluded, it is limited to the amount you paid us (if any) in the 12 months before the claim.

Note: Under EU consumer law, certain rights and liabilities cannot be excluded. Nothing in these Terms limits rights that cannot be limited by law.

10. Indemnification

You agree to indemnify and hold us harmless from any claims, losses, or costs arising from your misuse of the Service or breach of these Terms.

11. Disputes

Disputes are subject to the competent courts, unless mandatory consumer-protection law gives you the right to bring a claim elsewhere.

12. Changes

We may update these Terms. The "Last updated" date shows the current version. Continued use after changes means you accept the updated Terms.

Privacy Policy

This Privacy Policy explains how Qubix Quantum ("Qubix", "we", "us", "our") collects, uses, and protects personal data when you visit qubixquantum.com (the "Website") and use the Qubix services.

For the purposes of the EU General Data Protection Regulation (GDPR), we are the data controller. If you have any questions or want to exercise your rights, contact us at official@qubixquantum.com.

Note: We are based in the United States. This policy is written to comply with the EU General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA), each of which applies to users in those regions.

1. What data we collect

We only collect what we need:

Email address — when you submit it through the newsletter / "leave your email" form, so we can contact you with updates.
Technical and log data — when you visit the Website, our hosting and content-delivery providers automatically process your IP address, browser type, device information, referring page, and timestamps. This is standard server-log data used for security and to operate the Website.
Wallet address — (applies only to the Qubix app, app.qubixquantum.com) if you connect a Solana wallet to sign in, we process your public wallet address. We never have access to your private keys.
Account data — (Qubix app only) if you create an account with email and password, we process that login information.

We do not knowingly collect special-category data (health, religion, etc.) or data from children (see Section 9).

2. Why we use your data and our legal basis

We do not use your data for automated decision-making that produces legal effects on you.

3. Who we share your data with

We do not sell your personal data. We share it only with service providers ("processors") who help us run the service, under contracts that require them to protect it:

Netlify — website hosting.
Cloudflare — DNS, CDN, and security for the domain.
Supabase — database, authentication, and email handling.
Helio — (Qubix app only) payment processing for credits/purchases.

We may also disclose data if required by law or to protect our rights.

4. International data transfers

We are based in the United States, and our service providers may be located in the United States and other countries. If you access the Website or services from the European Economic Area (EEA), the United Kingdom, or another region, your personal data will be transferred to and processed in the United States. Where required, such transfers are protected by appropriate safeguards such as the EU Standard Contractual Clauses. You can request more details using the contact above.

5. How long we keep your data

Newsletter email: until you unsubscribe or ask us to delete it.
Account / app data: for as long as your account is active, then deleted or anonymised within a reasonable period.
Server logs: kept only for a short period for security and troubleshooting, then deleted.

6. Your rights

Under the GDPR you have the right to:

Access — get a copy of the data we hold about you.
Rectification — correct inaccurate data.
Erasure — ask us to delete your data ("right to be forgotten").
Restriction — limit how we use your data.
Portability — receive your data in a portable format.
Object — object to processing based on legitimate interests.
Withdraw consent — at any time, where we rely on consent.

To exercise any of these, email official@qubixquantum.com. We respond within one month.

You also have the right to lodge a complaint with your local data protection supervisory authority.

California residents (CCPA). If you are a California resident, you have the right to know what personal information we collect and how we use it, to request access to or deletion of that information, and to opt out of the sale of your personal information. We do not sell your personal information, and you will not be discriminated against for exercising your rights. To exercise them, email official@qubixquantum.com.

7. Cookies

The Website does not use tracking cookies or third-party analytics. Only strictly necessary technical processing (described in Section 1) takes place.

8. Security

We use reasonable technical and organisational measures (such as HTTPS encryption and access controls through our providers) to protect your data. No method of transmission over the internet is 100% secure, so we cannot guarantee absolute security.

9. Children

The Website and services are not directed at children under 18. We do not knowingly collect data from children. If you believe a child has provided us data, contact us and we will delete it.

10. Changes to this policy

We may update this policy from time to time. The "Last updated" date at the top shows the latest version. Material changes will be communicated through the Website.
